Delivery and responsibility for your package

Where delivery happens. We deliver your order to the shipping address you give us at checkout. For firearms and other items that must go through a licensed dealer, we deliver to the dealer you choose, at the dealer's licensed premises.

When it counts as delivered. Your order is delivered when the carrier:

• hands it to you or to someone at your shipping address,
• leaves it at your shipping address, in your mailbox, or in a parcel locker, mailroom, front desk or other spot the carrier normally uses for that address,
• leaves it where you or someone at your address told the carrier to leave it, or at a pickup point you chose, or
• for dealer orders, hands it to your dealer or the dealer's staff.

A carrier's delivery scan is strong evidence that delivery happened, but it is not the last word. If you tell us the carrier left it somewhere else, we will look at the carrier's records (location, photo, signature) with you.

Who is responsible before and after delivery. Your order is our responsibility until it is delivered. That is true whether we ship it ourselves or a supplier ships it for us, whichever carrier we use, and whatever you paid for shipping. Once it is delivered, it is yours, and so is the responsibility for it.

If your order is lost or damaged before delivery. We will make it right at no cost to you. You choose: we reship the same items, we refund the price you paid for the affected items and the sales tax on them, or we add the same amount as store credit plus a 5% bonus to your Shooting Surplus account (you need an account for this one). For a firearm, the choice is a reship or a refund, because store credit is not offered on firearms, and a lost NFA item is refunded. If nothing in the order arrived, what you paid for shipping comes back the same way as a refund or store credit. To help us do this quickly:

• Tell us within 30 days after the last tracking update if a package seems lost, and within 7 days of delivery if something arrived damaged. If you tell us later, we will still look at it fairly, but we may not be able to recover the loss from the carrier.
• For damage, send photos of the item, the box and the label, and keep the packing until we are done.
• Let us open a trace with the carrier. It usually takes 5 to 10 business days. We will fix the problem once the carrier finishes, or sooner if the carrier confirms the loss.

Our optional Shipping Protection adds faster fixes and protection against theft after delivery. Leaving it off does not reduce anything in this section. See Shipping Protection.

Your shipping address. Please give us a complete, correct address. If the address you enter is wrong or incomplete and the carrier delivers to it, that counts as delivery. If you spot a mistake, contact us right away and we will try to redirect the package.

Forwarding services. If you ship to a freight forwarder, reshipper or package-receiving service, delivery happens when that service receives the package.

Refused, not picked up, or returned to us. If you refuse a package, do not pick it up from the carrier, or it comes back to us because it could not be delivered for a reason that is not our fault, it is not a lost package. We will refund you once it is back with us, minus the original shipping and the return shipping.

Signature required. Some orders need an adult signature, as described in our Store Policies. If the carrier cannot get one after its delivery attempts, the package will go back to us and the paragraph above applies.

Dealer orders. For firearms and other items shipped to a licensed dealer:

• Delivery happens when your dealer receives the item.
• Please inspect the item at your dealer before you complete the transfer form (ATF Form 4473). Once you complete the transfer, the item is yours.
• Items can wait at a dealer for a background check, an appointment or NFA approval. For dealer orders, the time to report damage starts when you inspect the item at the dealer, not when the dealer receives it, up to 180 days after the dealer receives it.
• If an item is lost before it reaches your dealer, the shipper must report it to ATF as federal law requires, and the replacement or refund follows that process.

Recovering from the carrier. When we replace or refund a lost or damaged package, you agree that we (or our supplier) may pursue the carrier for the loss, and you will give us reasonable help, such as a short statement or photos.

Shooting Surplus LLC does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Shooting Surplus LLC does not make any warranties or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Limitation of Liability

Shooting Surplus LLC shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Shooting Surplus LLC has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors

In the event that a Shooting Surplus LLC product is mistakenly listed at an incorrect price, Shooting Surplus LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Shooting Surplus LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Shooting Surplus LLC shall issue a credit to your credit card account in the amount of the incorrect price.

Term & Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Shooting Surplus LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, and Miscellaneous shall survive any termination.

Notice

Shooting Surplus LLC may deliver notice to you by means of email, a general notice on the site, or by other reliable method to the address you have provided to Shooting Surplus LLC.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of Louisiana, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Shooting Surplus LLC products) shall be in the state or federal courts located in Lincoln Parish, Louisiana. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Shooting Surplus LLC products) must be commenced within one (1) year after the claim or cause of action arises.

Shooting Surplus LLC's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Shooting Surplus LLC may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site

Harassment in any manner or form on the site, including via email, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Shooting Surplus LLC or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.

Participation Disclaimer

Shooting Surplus LLC does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. Indemnification
